Terms of Service

Please read these Terms of Service (“Terms”) carefully. By creating an account or using Bakantify (the “Service”), you agree to these Terms.
1. What Bakantify Is
Bakantify connects publishers, who share approved ads on their WhatsApp Status and earn credits for verified views, with advertisers, who spend credits to reach publishers by location.
2. Eligibility
You must be at least 18 years old to create an account or use Bakantify. By using the Service, you represent that you meet this requirement.
Bakantify may be available to users in various locations, and available advertising areas or features may vary by location.
3. Your Account
You are responsible for providing accurate information and keeping your login credentials secure. You must verify your email address before you can sign in. If you sign up to earn credits, you must complete WhatsApp verification — including saving our official contact and submitting a screenshot for review — before you can accept your first assignment.
4. Publisher Terms
As a publisher, you may accept assignments to post approved ads to your own WhatsApp Status. You confirm you've posted an ad using a simple self-reported button in the app. There is no penalty for taking a post down early, but credits are based only on views we are able to verify.
You must submit a valid screenshot as proof of posting. We review every submission manually. An invalid, missing, or unreviewable screenshot may result in no credit being issued. Bakantify has final discretion in reviewing proof submissions and determining verified views and credits. Every new publisher's first assignment is a Bakantify promotional post, which must be completed before you can accept ads from advertisers.
Credits are calculated based on verified views, at a rate we determine and may adjust from time to time as reflected in the app. Verified views are determined solely by our review of the screenshot you submit — not by any automated or third-party view count.
5. Advertiser Terms
As an advertiser, you may submit ad content — including images, video, captions, and links — for our review. All ads must be approved by Bakantify before they can run, and we may reject or request changes to any submission at our discretion (see Section 7, “Content Standards”).
By uploading content, you confirm that you own it or otherwise have the right to use it, and you grant Bakantify a license to store, display, modify (including adding a Bakantify watermark), and distribute it solely to operate the Service. You remain responsible for the content you submit.
Campaigns are funded using credits — whether earned, given as a bonus, or purchased. Bakantify does not guarantee a specific number of views, any particular business outcome, or any particular result from a campaign.
6. Purchased Credits
You may purchase credits using a credit or debit card, processed entirely by Stripe. Bakantify never receives or stores your card details.
Purchased credits are generally final and non-refundable once issued. However, if you believe you were charged in error — for example, a billing mistake or a duplicate charge — or believe another exceptional circumstance applies, contact us at info@bakantify.com. We will review the request, but a refund is not automatic or guaranteed.
7. Content Standards
We may reject, remove, or request changes to any ad at our discretion. Ads may not contain or promote:
- illegal content or activity
- fraudulent or deceptive content
- obscene content
- hateful content
- threatening content
- content that infringes someone else's intellectual property rights
- content that infringes someone else's privacy rights
- products or services we determine are unsuitable for our audience
- content that is otherwise inappropriate for the Service
8. Our Right to Review, Restrict, or Terminate
We may review, reject, or remove any ad, verification, or proof submission. We may restrict access to features or terminate an account for violating these Terms, misusing the Service, or submitting fraudulent proof or verification materials.
9. No Guarantee of Availability
We aim to keep Bakantify available and reliable, but we don't guarantee uninterrupted access to the Service, and we are not liable for losses caused by downtime, maintenance, or technical issues.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. Bakantify does not warrant that the Service will be uninterrupted, secure, or error-free, or that any particular number of views, engagement, or business result will occur.
11. Limitation of Liability
To the fullest extent permitted by law, Bakantify and its officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service — even if advised of the possibility of such damages.
To the fullest extent permitted by law, Bakantify's total liability to you for any claim arising out of or related to the Service will not exceed the total amount you paid to Bakantify for purchased credits in the twelve (12) months before the claim arose, or one hundred dollars ($100), whichever is greater.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold Bakantify harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles.
14. Changes to These Terms
We may update these Terms from time to time. Continuing to use the Service after a change means you accept the updated Terms.
